The basic principle is straightforward: a judgment given in one EU Member State is recognized in the other Member States without any special procedure being required. Accordingly, an enforceable judgment from Germany, France or Italy is, in principle, treated in Austria in the same way as a judgment issued by an Austrian court.

To enforce a judgment given in another EU Member State in Austria, the creditor generally only needs to provide the competent Austrian enforcement court with a copy of the judgment, together with a certified translation into German where required and the standardized certificate pursuant to Article 53 of the Brussels Ia Regulation. Issued by the court of origin, this certificate confirms the enforceability of the judgment. A separate procedure for declaring the judgment enforceable (exequatur proceedings) is no longer required.

However, even under the Brussels Ia regime, practical pitfalls remain. For example, an incomplete or incorrect Article 53 certificate may result in delays in enforcement. It is likewise essential to ensure that the judgment is actually enforceable in the Member State of origin and that the certificate accurately reflects the scope of enforcement. Moreover, the abolition of exequatur proceedings does not mean that a debtor is unable to challenge enforcement. Under the Brussels Ia Regulation, enforcement may, in particular, be challenged on certain narrowly defined grounds for refusal of recognition or on the basis of procedural defects.

In practice, successful cross-border enforcement therefore requires careful preparation already during the proceedings in the Member State of origin. Creditors should anticipate potential enforcement abroad at an early stage and ensure that all documents required for enforcement in the relevant Member State are complete and formally correct.

2. Grounds for Refusing Enforcement Within the EU

The Brussels Ia Regulation provides mechanisms for challenging the enforcement of a judgment from another EU Member State. A debtor may apply for recognition or enforcement to be refused, but only on the grounds exhaustively set out in Article 45 of the Brussels Ia Regulation. These grounds are interpreted narrowly by the courts. A substantive review of the foreign judgment (so-called révision au fond) is strictly prohibited.

The main grounds for refusal under Article 45 of the Brussels Ia Regulation include:

Public policy (ordre public): Recognition of the judgment would be manifestly contrary to fundamental principles of the Austrian legal order. This is a high threshold and is rarely applied in practice.

Violation of the right to be heard: Where the judgment was given in default of appearance, the document instituting the proceedings must have been served on the defendant in sufficient time and in a proper manner to enable the defendant to arrange for their defence.

Incompatibility with other judgments: The judgment is incompatible with an earlier judgment given between the same parties in Austria, or with an earlier judgment given in another state which is also recognized in Austria.

3. Judgments from Third Countries: No Automatic Recognition and Enforcement

The enforcement of judgments from third countries – i.e. countries outside the EU and the EEA – is fundamentally different from the regime applicable within the EU. The principle of automatic recognition, which is based on mutual trust between EU Member States, does not apply. Instead, a formal procedure for declaring the foreign judgment enforceable, known as exequatur proceedings, must generally be completed.

A key requirement is the “guaranteed reciprocity” (verbürgte Gegenseitigkeit) required under Section 406 of the Austrian Enforcement Code (Exekutionsordnung, EO). In essence, the creditor must establish that Austrian judgments are likewise recognized and enforced in the state of origin of the foreign judgment. This requirement is particularly important in practice, as the Austrian Supreme Court (Oberster Gerichtshof, OGH) interprets the concept of guaranteed reciprocity strictly. It is not sufficient to demonstrate merely that the relevant third country has, in an individual case, actually recognized or enforced an Austrian judgment. Rather, a formal and legally binding guarantee of reciprocity is required.

In practice, this requirement generally points towards the existence of a bilateral treaty governing the recognition and enforcement of judgments. Austria, however, has not concluded such treaties with all countries. The applicable legal framework must therefore be examined carefully on a case-by-case basis.

This strict requirement can have significant consequences. In particular, the enforcement of civil judgments from major economic jurisdictions such as the United States, with which Austria does not have a comprehensive bilateral treaty of this kind, may face substantial obstacles where guaranteed reciprocity cannot be established.

4. The Post-Brexit Reality: Enforcement of Judgments from the United Kingdom

Since the United Kingdom’s withdrawal from the European Union, the straightforward enforcement regime under the Brussels Ia Regulation no longer applies to UK judgments. The legal position has therefore become considerably more complex. In certain cases, the 2005 Hague Choice of Court Convention may provide a legal framework for recognition and enforcement. In many other cases, however, Austrian domestic law must be considered.

Depending on the circumstances, different legal bases may be relevant. These include, for example, the Treaty between the Republic of Austria and the United Kingdom of Great Britain and Northern Ireland on the Reciprocal Recognition and Enforcement of Judgments in Civil and Commercial Matters (BGBl 1962/224). It is important to note, however, that according to Austrian case law, this treaty primarily covers judgments of “superior courts”, whereas judgments rendered by a “lower” British court do not fall within its scope (RIS-Justiz RS0002320).

In addition, international instruments such as the 2005 Hague Choice of Court Convention or the 2019 Hague Judgments Convention may be relevant, depending on the circumstances. Ultimately, companies and creditors seeking to enforce a UK judgment in Austria following Brexit must carefully determine the applicable legal basis for recognition and enforcement. The availability of enforcement will depend on the nature and origin of the judgment, the court that issued it, any applicable international convention or bilateral treaty, and the requirements of Austrian enforcement law.

 5. Jurisdiction and Procedure in Austria

The jurisdiction of the Austrian courts for the recognition and enforcement of foreign judgments must also be carefully assessed:

EU judgments (under the Brussels Ia Regulation): The creditor may generally apply directly for enforcement to the competent Austrian enforcement court. This will usually be the district court (Bezirksgericht) in whose jurisdiction the debtor is domiciled or where assets subject to enforcement, such as a bank account, are located.

Judgments from third countries (e.g. the UK): As a first step, an application for a declaration of enforceability must generally be filed. The competent court is the district court at which the debtor has their general place of jurisdiction in Austria or the district court that would otherwise have jurisdiction over enforcement against the relevant assets. Only once the decision declaring the foreign judgment enforceable has become final can enforcement proceedings themselves be initiated. Once declared enforceable, the foreign judgment is treated in the same manner as a domestic enforceable title.

6. Conclusion: Careful Compliance with Procedural Requirements Is Key

The enforcement of foreign judgments in Austria is governed by different rules depending on whether the judgment originates from an EU Member State or a third country. Within the EU, the Brussels Ia Regulation substantially facilitates cross-border enforcement: a separate exequatur procedure is generally no longer required. By contrast, judgments from third countries, such as the United Kingdom, may require a formal and potentially more complex procedure before enforcement can take place.

The potential obstacles also differ significantly. While the grounds for refusing recognition or enforcement under the Brussels Ia Regulation are narrowly defined, judgments from third countries may face substantial hurdles at the recognition and enforcement stage itself, including the requirement to establish reciprocity.

Regardless of the origin of the judgment, one principle remains constant: successful and efficient cross-border enforcement requires a careful assessment of the applicable legal framework and strict compliance with the relevant procedural and formal requirements. Particularly in international matters, requirements that may initially appear to be mere formalities can ultimately determine whether a claim can be effectively enforced.

Looking to Enforce a Foreign Judgment in Austria?

LEUKOS Rechtsanwälte in Vienna advises and represents creditors in the recognition and enforcement of foreign judgments in Austria.

Contact us for a consultation at office@leukos.at or by telephone at +43 1 208 04 50.

In today’s globalized economy, cross-border business relationships are commonplace.
